Steps in a Property Sale

You can count on the team at Linda Emery & Associates and Conveyancing Central Coast to help you during the process of selling your residential or commercial property in Gosford. There are a number of stages in the process, we’ll work with you to minimise stress and streamline the sale.


  1. Linda Emery and her team will prepare the Contract for Sale and forward this on your behalf to your real estate agent
  2. Once we’ve found a buyer, agreed on the sale price, we’ll exchange the contracts between yourself and your prospective purchaser
  3. You’ll be required to arrange a signing of your Discharge of Mortgage documents with your bank. This is so we can obtain a payout figure of your loan in readiness for property settlement
  4. As the settlement date is advised, you’ll make arrangements to disconnect your services i.e. electricity, internet, advise your insurance company of the date and schedule a removalist.

Common Documentation Required

Property law in New South Wales can be complicated and overwhelming. Our solicitors & conveyancers can cut through the legal jargon and make it as simple and stress free as possible. As the seller or Vendor, you are currently required by law to prepare a Contract for Sale to provide to your real estate agent. Our solicitors will consult with you closely to assist this process. There are a number of documents required to be annexed including:


  • Section 149 Certificate (zoning)
  • Sewer mains diagram
  • Title search
  • Pool compliance certification (if appropriate)
  • Land tax clearance certificate
  • Copies of any documents of any notifications registered on the property title

Property Settlement Process

The settlement is the final hurdle before handing over the keys. At Conveyancing Central Coast, our aim is to ensure a speedy process on your behalf. Settlement can take approximately 6 weeks and it starts on the day the Contract of Sale is signed up until the date ownership is scheduled to transfer. This time period is specified between yourself and the buyer. 


Prior to the settlement date, your buyer can take the opportunity to undertake a final property inspection. This isn’t mandatory and is at the buyer’s discretion to inspect the house and potentially check if you’ve completed any outstanding jobs as part of your contract. 


On settlement day, we’ll liaise with the buyer’s legal representative to confirm that all conditions in the contract have been met. We’ll oversee the transfer process to the buyer and notify you when it’s completed.
